Omaza.ai operates a lead generation platform that connects local businesses with potential customers seeking their services. Our platform:

  • Generates leads through various marketing channels on behalf of Omaza
  • Delivers qualified leads exclusively to registered customers
  • Provides a dashboard interface for lead management and tracking
  • Operates within the United States territory

2.2 Lead Exclusivity

Each lead is distributed exclusively to one single customer.We do not sell, share, or distribute the same lead to multiple businesses. Once a lead is delivered to you, you have exclusive rights to pursue that business opportunity.

2.3 Geographic Coverage

Our services currently operate within the United States. All leads generated are for services within U.S. territories, and all transactions are processed in U.S. dollars (USD).

3. Account Registration and Eligibility

3.1 Eligibility Requirements

To use Omaza.ai, you must:

  • Be at least 18 years of age
  • Operate a legitimate business in the United States
  • Have the legal authority to enter into this agreement
  • Provide accurate and complete registration information
  • Maintain a valid payment method on file

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach
  • Ensuring your account information remains current and accurate

3.3 Prohibited Use

You may not:

  • Share or transfer your account to another person or entity
  • Create multiple accounts for the same business
  • Use the platform for any illegal or unauthorized purpose
  • Attempt to circumvent payment requirements
  • Resell or redistribute leads to third parties

4. Pricing and Payment Terms

4.1 First Lead Free Promotion

Your first lead is completely free.No payment method is required to receive your first qualified lead. This promotional offer applies once per customer lifetime and cannot be combined with other offers.

4.2 Subsequent Lead Charges

After your first lead, you will be charged for each additional lead delivered to your account. Pricing is transparent and displayed in your dashboard before you commit to receiving leads.

4.3 Payment Authorization

By providing payment information, you authorize Omaza.ai to:

  • Charge your payment method for each lead delivered (after the first free lead)
  • Automatically process charges as leads are generated
  • Update charges if pricing changes (with advance notice)
  • Store your payment information securely for future transactions

4.4 Failed Payments

If a payment fails, lead delivery will be immediately paused.We will:

  • Notify you via email of the failed payment
  • Suspend new lead generation until payment is resolved
  • Retain your account and existing leads in your dashboard
  • Resume service once a valid payment method is provided

4.5 Budget Controls

You may set daily and monthly spending limits through your dashboard. We will not exceed your specified budget without your explicit authorization. You may adjust these limits at any time.

4.6 Billing Cycle

Charges are processed on a per-lead basis immediately upon delivery. Detailed billing information is available in your dashboard at any time.

4.7 Taxes

All fees are exclusive of applicable taxes. You are responsible for any sales, use, value-added, or other taxes associated with your use of our services.

5. Lead Quality and Responsibility

5.1 Lead Qualification

Omaza.ai makes reasonable efforts to ensure leads meet basic qualification criteria, including:

  • Valid contact information
  • Expressed interest in relevant services
  • Geographic alignment with your service area
  • Recent inquiry (typically within 24-48 hours)

5.2 Customer Responsibility

From the moment a lead is delivered to you, the entire responsibility for the relationship with that lead belongs to you, not Omaza.This includes:

  • Initial contact and follow-up communications
  • Professional conduct and service delivery
  • Compliance with all applicable laws and regulations
  • Handling of any disputes or complaints
  • Privacy and data protection of lead information
  • Timely response to inquiries

5.3 Lead Validity Period

Leads remain accessible in your dashboard indefinitely. However, we recommend contacting leads within 24 hours of delivery for optimal conversion rates.

5.4 No Conversion Guarantee

While we strive to provide high-quality leads, Omaza.ai does not guarantee that any lead will result in a sale, contract, or business transaction. Conversion depends on numerous factors within your control, including:

  • Your response time and communication skills
  • Pricing and service competitiveness
  • Professional reputation and reviews
  • Quality of your proposal or quote

6. Dashboard and Lead Management

6.1 Dashboard Access

Your dashboard provides tools to:

  • View all delivered leads with full contact information
  • Update lead status throughout your sales process
  • Add notes and track communication history
  • Filter and search leads by various criteria
  • Monitor spending and budget utilization
  • Manage account settings and preferences

6.2 Status Management

You are encouraged to keep lead statuses current. This helps you:

  • Track your sales pipeline effectively
  • Identify follow-up opportunities
  • Measure conversion rates and ROI
  • Organize your workflow

6.3 Demo Mode

A demo mode is available to explore platform features with sample data. Changes made in demo mode are not saved and do not affect your actual leads or account.

7. Refund and Dispute Policy

7.1 Refund Eligibility

Refunds may be issued in the following circumstances:

  • Lead information is demonstrably fraudulent or invalid
  • Duplicate lead delivered within 30 days
  • Lead does not match your specified service criteria
  • Technical error in lead delivery

7.2 Refund Request Process

To request a refund:

  1. Submit a request within 7 days of lead delivery
  2. Provide specific reason and supporting documentation
  3. Allow up to 5 business days for review
  4. Approved refunds are processed within 10 business days

7.3 Non-Refundable Situations

Refunds will not be issued for:

  • Leads you chose not to contact
  • Leads that did not convert to sales
  • Customer changed their mind or found another provider
  • Pricing concerns raised after receiving the lead
  • Requests made more than 7 days after delivery

8. Data Privacy and Security

8.1 Data Collection and Use

Your data will only be used for business purposes, including:

  • Service delivery and platform operation
  • Business communications and support
  • Account management and billing
  • Service improvements and analytics
  • Legal compliance and fraud prevention

8.2 Lead Data Protection

You agree to:

  • Protect lead information from unauthorized access
  • Use lead data solely for legitimate business purposes
  • Comply with all applicable privacy laws (including CAN-SPAM, TCPA)
  • Not sell, share, or misuse lead contact information

8.3 Data Security

Omaza.ai implements industry-standard security measures to protect your data. However, no internet transmission is completely secure, and you acknowledge the inherent risks of electronic communication.

8.4 Data Retention

We retain your account data and lead history for as long as your account is active and for a reasonable period thereafter as required for business and legal purposes.

9. Intellectual Property

9.1 Omaza Property

All content, features, and functionality of the Omaza.ai platform, including but not limited to text, graphics, logos, software, and design, are owned by Omaza.ai and protected by intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our platform for its intended purpose. You may not:

  • Copy, modify, or create derivative works
  • Reverse engineer or decompile any aspect of the platform
  • Remove or alter any proprietary notices
  • Use our branding without written permission

10. Service Modifications and Termination

10.1 Service Changes

Omaza.ai reserves the right to:

  • Modify or discontinue features with reasonable notice
  • Update pricing with 30 days advance notice
  • Change service areas or lead types offered
  • Improve or enhance platform functionality

10.2 Account Suspension

We may suspend or terminate your account if:

  • You violate these Terms
  • Payment failures remain unresolved for 30 days
  • You engage in fraudulent activity
  • Your use threatens platform integrity or other users
  • Required by law or legal process

10.3 Voluntary Cancellation

You may cancel your account at any time through your dashboard or by contacting support. Upon cancellation:

  • No further leads will be delivered
  • You retain access to historical lead data for 90 days
  • Outstanding charges remain due and payable
  • No refunds for unused budget or prepaid services

11. Warranties and Disclaimers

11.1 Service "As Is"

OMAZA.AI PROVIDES THE PLATFORM "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.2 No Guarantee of Results

We do not guarantee:

  • Specific number of leads within any timeframe
  • Lead quality beyond basic qualification criteria
  • Conversion rates or business outcomes
  • Uninterrupted or error-free service
  • Compatibility with all devices or browsers

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • OMAZA.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO OMAZA.AI IN THE 12 MONTHS PRECEDING THE CLAIM
  • WE ARE NOT LIABLE FOR LOSSES RESULTING FROM YOUR INTERACTIONS WITH LEADS
  • WE ARE NOT RESPONSIBLE FOR THIRD-PARTY ACTIONS OR PLATFORM INTEGRATIONS

13. Indemnification

You agree to indemnify, defend, and hold harmless Omaza.ai, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

  • Your use of the platform
  • Your violation of these Terms
  • Your interactions with leads
  • Your violation of any third-party rights
  • Your business practices or service delivery

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the State of [Your State], United States, without regard to conflict of law provisions.

14.2 Arbitration Agreement

Any dispute arising from these Terms or your use of Omaza.ai shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, rather than in court, except that you may assert claims in small claims court if they qualify.

16. Changes to Terms

Omaza.ai reserves the right to modify these Terms at any time. We will notify you of material changes via:

  • Notice in your dashboard
  • Update to the "Last Updated" date above

Continued use of our services after changes become effective constitutes acceptance of the modified Terms. If you disagree with changes, you may terminate your account.
